Forming an LLC
Once you have come up with an name for your LLC and you are ready to set it up, you will need to file your articles of organization with your state’s filing office for LLCs. You may also find these documents referred to as a “certificate of formation” or “certificate of organization.”
A negative aspect of forming an LLC rather than something else like a sole proprietorship or partnerships is the fact that it involves a fee for filing as you turn in your articles of organization. In a majority of states you will find the fees to be reasonable, but some states are a little greedier. Some states additionally will charge a yearly tax in addition to the filing fee.
The good news is that articles of organization are relatively brief and easy to fill out. It shouldn’t take longer than a couple of hours, and is normally a matter of checking the correct boxes and filling out the blank spaces. You will have to document your LLC’s name, location and most likely the members.
Usually you will select one of the members to act as the registered agent. The registered agent is responsible for any legal matters involving the llc. The whole process is easier than moste people think, and once you get started, you’ll be well on your way.
